Creator Terms of Service.

1. Creator Accounts

• Creator accounts require a paid subscription ($20/month).
• You must connect a Stripe Connect account to receive payouts.
• You are responsible for all tax obligations related to your earnings. We do not withhold taxes on your behalf.
• You represent that you are legally able to enter into binding agreements and sell digital goods in your jurisdiction.

2. Revenue Split

• Creators receive 90% of each sale. The platform retains a 10% commission.
• Payment processing fees (Stripe's standard fees) are deducted from the gross sale amount before the split.
• Payouts are issued to your connected Stripe account after payment clears.
• We reserve the right to hold payouts if we suspect fraud or policy violations, pending investigation.

3. Your Listings

• You own your content. You retain all rights to the personas, skills, and digital goods you create and publish.
• You grant us a license to host, display, distribute, and promote your Listings on Claw Mart and related marketing channels.
• You are solely responsible for the content, functionality, accuracy, and legality of your Listings.
• You represent and warrant that your Listings do not infringe any third-party intellectual property rights, do not contain malicious code, and comply with all applicable laws.

4. Content Policy

The following are strictly prohibited:

• Malicious code, harmful payloads, or content designed to damage systems or data.
• Impersonation of real people, brands, or organizations without authorization.
• Stolen, plagiarized, or unlicensed content.
• Content that facilitates illegal activity.
• Deceptive descriptions or misleading claims about what a Listing does.

5. Bounty Submissions

When submitting to bounties on the Bounty Board:

• You may submit one entry per bounty.
• You may submit an existing Listing or a new skill via URL.
• You can only submit Listings you own.
• Submissions are visible only to the bounty poster and yourself.
• Award payouts: If your submission is selected as the winner, you receive 90% of the bounty amount via your Stripe Connect account. Claw Mart retains 10%.
• Split payouts: If the bounty expires without a winner being selected, 90% of the bounty is split equally among all submitters. You must have an active Stripe Connect account to receive your share.
• Awards are final. We do not mediate disputes between bounty posters and submitters.

6. Takedown & Enforcement

• Listings reported for policy violations may be removed or hidden during review.
• Verified violations require correction or result in permanent removal.
• Repeated or severe violations may result in account termination and forfeiture of pending payouts.
• We may remove any Listing at our sole discretion if we believe it poses a risk to users, the platform, or our reputation.

7. Indemnification

As a creator, you agree to indemnify and hold harmless The Masinov Company, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your Listings; (b) any buyer's use of your Listings; (c) any claim that your Listing infringes third-party rights; or (d) your violation of these Terms.

8. Limitation of Liability

WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE PLATFORM AS A CREATOR, INCLUDING BUT NOT LIMITED TO LOST REVENUE, LOST PROFITS, OR LOSSES RESULTING FROM PLATFORM DOWNTIME, PAYMENT PROCESSING ISSUES, OR BUYER DISPUTES. Our total liability to you shall not exceed the fees you have paid to us in the 12 months preceding the claim.

9. Account Termination

We may suspend or terminate your creator account at any time for any reason. Upon termination: (a) your Listings will be removed from the marketplace; (b) pending payouts for completed, non-disputed sales will be processed; (c) your obligation to indemnify us survives termination.

10. Governing Law

These Creator Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas.
